Terms and Conditions

Definition of Contract Terms

For the purposes of this document, the terms below shall have the following meanings.

Client

Means a natural person of legal age who has full legal capacity at the time the reservation contract is entered into, or a legal entity duly represented by a natural person who has the authority and legal capacity to represent it.

Hotel

Refers to Manoir du Stang Hôtel du Golf, LLC.

Website

An online service operated by Manoir du Stang on the Internet and accessible at the address indicated in the preamble to this document.

Booking platform

An online service linked to the website that allows users to make online reservations for the Manoir du Stang hotel.

Services

Refers to all services offered by the Hotel, including, in particular, lodging, related services (breakfast, dining, options, and additional services), as well as any other services provided as part of a reservation.

Reservation

Refers to any order for services placed by the Customer via the Website or by any other means, and confirmed following acceptance of these general terms and conditions of sale and the terms of the selected rate. The reservation is considered final upon confirmation by the Hotel, which is provided via a summary email.

Preamble

Manoir du Stang Hôtel du Golf SARL (a limited liability company), registered under SIREN number 385 077 730, listed in the Quimper Trade and Companies Register, and located at Manoir du Stang, Le Stang, 29940 La Forêt-Fouesnant, operates the following booking website: www.manoirdustang.com.

This website provides information about the Manoir du Stang hotel and allows users to book rooms and hotel services. These terms and conditions apply to the website mentioned above.

The Customer acknowledges that they had all the necessary information to make their selection and proceed with their reservation on the Website.

It is agreed that:

  • These Terms and Conditions of Sale apply to all reservations made on the Manoir du Stang hotel website by individual customers;
  • These General Terms and Conditions of Sale are not intended to apply to business customers who have entered into a specific contract.

Any reservation made through the Website implies that you have read and fully and unreservedly accepted these general terms and conditions of sale, as well as the terms and conditions of sale for the selected rate, which are expressly stated in the description of the selected rate at the time of booking.

The Customer’s acceptance of these Terms and Conditions and the terms of sale for the rate is final once the checkbox has been selected during the booking process on the Website; no booking is possible without this agreement.

The Customer acknowledges that they fully understand these Terms and Conditions, which are written in French or English, and that they have full legal capacity to enter into these Terms and Conditions.

The Website contains the following information:

  • a detailed description of the Manoir du Stang hotel;
  • the key features of the accommodations offered by the hotel;
  • the additional and optional services offered;
  • photographs provided for illustrative purposes only;
  • prices inclusive of all taxes, excluding the tourist tax;
  • the amount of the tourist tax as applied by the administrative authorities, which is subject to change;
  • the terms and conditions of sale for the reserved rate;
  • the payment terms;
  • these general terms and conditions of sale;
  • the validity period of the offer and its price.

The Customer represents that this reservation is made strictly for personal use. As a consumer, the Customer has specific rights, which would be compromised if the reserved services were not intended for personal use.

All information available on the Website, as well as these Terms and Conditions of Sale, are provided in both French and English.

These Terms and Conditions of Sale set forth the rights and obligations of the parties in connection with reservations made on the Manoir du Stang hotel website.

The Customer acknowledges having read these General Terms and Conditions of Sale and the terms and conditions of sale for the selected rate, which are accessible and available at any time on the Website. The Customer accepts them without reservation.

These Terms and Conditions of Sale apply for as long as the services of the Manoir du Stang hotel are available online.

Manoir du Stang Hôtel du Golf, LLC reserves the right, without prior notice or compensation, to modify these terms and conditions of sale, or to temporarily or permanently close the website or the online booking portal. We therefore encourage you to review them regularly.

These Terms and Conditions of Sale are effective as of the date of the Customer’s reservation. If a later version is issued after the Customer’s reservation, these Terms and Conditions shall not apply to that reservation.

Manoir du Stang, LLC is not liable for any damages of any kind that may result from such modifications and/or from the temporary unavailability or permanent closure of all or part of the Website or the services associated with it, such as the online booking section.

The Guest acknowledges that they have made their reservation with full knowledge of the facts and have obtained all necessary information for this purpose. Room reservations are limited to natural persons who are of legal age and legally competent. By making a room reservation at the Manoir du Stang hotel, the Guest expressly declares that they meet these conditions.

The Customer must contact the sales department of the Manoir du Stang hotel by email or phone to review the specific terms and conditions for group reservations and to finalize such a reservation.

The Customer is solely responsible for selecting services and ensuring they meet their needs; accordingly, SARL Manoir du Stang cannot be held liable in this regard.

The reservation is deemed to have been accepted by the Customer upon completion of the booking process.

All reservations are non-transferable and may not under any circumstances be transferred to a third party, whether for free or for a fee. Any reservation made on behalf of another person must be made in the name of the third party who will be staying.

Reservation Process

The Customer may book a room on the booking platform accessible via the Website by clicking the “Book” button.

The Guest specifies the dates of their stay and the number of people staying. They can then choose the room type and any additional services based on their needs, and select the rate offered for the selected date(s).

The Customer can then confirm their selection by clicking the “Book” button after reviewing the full description of the corresponding room(s) and the included services.

The Customer is then asked to fill out a form providing all of their personal information, as well as that of the people staying at the hotel. They must then provide their banking information to guarantee the reservation. The Customer certifies that the information provided is true and accurate.

The Customer is then asked to confirm their reservation after reviewing and accepting the terms and conditions for the selected rate, as well as the booking platform’s privacy policy.

The reservation is confirmed. The Customer is directed to a page containing a summary of their reservation. A reservation confirmation is sent by email to the address provided by the Customer in the form.

Cancellation or Change Policy

If the Customer has booked a non-cancellable, non-refundable rate, they may not cancel their reservation under any circumstances and will not be entitled to a refund, even if they request one.

If the Customer has booked a flexible rate, they may cancel or modify their reservation in accordance with the terms and conditions of the rate selected at the time of booking.

Canceling or changing a reservation may result in charges, as specified in the terms and conditions of the rate selected at the time of booking.

To cancel or modify a reservation, the Guest must contact the Hotel using the contact information provided on the Website.

In the event of exceptional circumstances or if the reserved room cannot be made available to the Guest—for example, due to force majeure—the Manoir du Stang hotel may offer the Guest a room of a higher category than the one reserved or alternative accommodations at a hotel of at least equivalent category.

The Customer is reminded, in accordance with Article L. 221-28 of the French Consumer Code, that he or she does not have the right of withdrawal provided for in Article L. 221-18 of the French Consumer Code. The Customer is also reminded that the terms and conditions of sale for the rate selected and accepted by him or her specify the procedures for canceling and/or modifying the reservation.

Stay at the Manoir du Stang Hotel

Police record and identification document

Upon arrival at the Manoir du Stang hotel, the Guest may be asked to fill out a police registration form. To do so, the Guest must present a valid form of identification so that the hotel can determine whether or not it is required to complete the police registration form.

Important note: If the Guest fails to present a valid form of identification upon arrival, the Hotel reserves the right to refuse the Guest access. Under no circumstances will the Hotel be required to pay the Guest any compensation.

Use of the room and common areas

The Guest agrees and undertakes to use the room and the Hotel’s common areas made available to them in a reasonable manner. Any behavior that violates safety and/or hygiene standards, public decency, and/or public order may result in the Hotel asking the Guest to leave the premises immediately, without any compensation and without a refund if payment has already been made.

The Guest may be charged directly for any damage caused in the reserved room or in the Hotel’s common areas, up to the amount of the damage observed. Any item missing from the reserved room and duly noted by the Hotel will be charged directly at its full value.

All rooms at the hotel are non-smoking. Penalties of up to the cost of the first night’s stay may be imposed if the guest fails to comply with the no-smoking policy in their room.

The Manoir du Stang Hotel has a set of House Rules for guests. The guest agrees to and undertakes to comply with these rules. In the event that the guest fails to comply with any provision of the House Rules, the hotel may ask the guest to leave the premises. Under no circumstances shall the hotel be required to pay the guest any compensation.

The Hotel provides complimentary access to unsupervised common areas and facilities, which are available exclusively to Hotel guests—unless otherwise specified by Hotel Management, which reserves the right to do so.

Use of these facilities and their equipment is the sole and full responsibility of the Customers, who may access them freely, but only during business hours. Unaccompanied minors are not permitted to enter on their own.

In the event of equipment malfunction or suspended or unavailable access for any reason whatsoever, the Guest shall not be entitled to claim any damages or compensation from the Hotel. In the event of the Guest’s failure to comply with any of these provisions, the Hotel may ask the Guest to leave the premises. Under no circumstances shall the Hotel be required to pay the Guest any compensation.

Check-in and check-out times

Guests may check into their room on the first day of their reservation starting at 3:00 p.m. They must check out of the room on the last day of their reservation by 11:00 a.m. Failure to do so will result in a charge for an additional night. Guests may enter and leave the hotel 24 hours a day. In such cases, they will be asked to leave their room keys at the front desk.

Guests may request early check-in before 3:00 p.m. on the day of arrival or late check-out after 11:00 a.m. on the day of departure. This service must be arranged on-site with hotel staff, subject to an additional fee and availability.

Pets

The Manoir du Stang Hotel does not allow pets.

Warranties

The Hotel is required to provide services that comply with the reservation made by the Guest and is liable for any lack of conformity under the terms set forth in the Consumer Code.

Guests are asked to report any issues or complaints upon arrival or during their stay so that the hotel can address them as soon as possible.

Unless a complaint is filed during the stay, no dispute will be considered after the Guest’s departure, except in duly justified cases.

Liability

The photographs displayed on the Website are not binding. Although every effort is made to ensure that the photographs, graphics, and text used to illustrate the hotel provide as accurate a representation as possible of the accommodation services offered, variations may occur, particularly due to changes in furnishings or renovations. The Customer may not make any claims on this basis.

In accordance with the laws and regulations governing intellectual property rights, the use and/or reproduction of all or part of the content comprising the Manoir du Stang hotel’s offerings on the Website is strictly prohibited.

Manoir du Stang shall not be liable for any consequential damages arising out of or in connection with this agreement, including those caused by a third party, the Customer, or the partners of the Manoir du Stang hotel.

Hyperlinks may direct users to websites other than the Manoir du Stang hotel website, which accepts no responsibility for the content of such websites or the services offered thereon. Manoir du Stang has implemented measures to protect and secure its information system against malicious acts. However, by accessing the Website and making a reservation, the Customer acknowledges and accepts the characteristics and limitations of the internet: the lack of protection for certain data against potential misuse or hacking, or the risk of infection by viruses circulating on the network. Manoir du Stang disclaims all liability in the event of misuse or incidents related to the use of a computer or any device enabling internet access, the maintenance or malfunction of the Website or any other technical connection, as well as the transmission of information to an incorrect address.

Any reservation or payment that is irregular, invalid, incomplete, or fraudulent for reasons attributable to the Customer will result in the cancellation of the reservation at the Customer’s expense, without prejudice to any civil or criminal action against the Customer.

In connection with their reservation and stay, the Guest agrees to behave reasonably and not to cause harm in any way to the Hotel staff or to third parties present in the Hotel. Such behavior may result in the Hotel removing the Guest from the premises, without the Guest being entitled to claim any compensation.

Price

The prices for booking services are displayed before and during the booking process.

The prices shown are per room for the number of guests and dates selected at the time of booking.

Prices are quoted to the Guest inclusive of all taxes (TTC) and exclusive of the tourist tax, in the hotel’s official currency, and are valid only for the period indicated on the Website.

The total amount of the reservation is payable at the time of booking or upon the Guest’s arrival at the Hotel, depending on the terms of the selected rate.

The Customer’s credit card information is required at the time of booking to guarantee or process payment for the reservation, depending on the terms of the selected rate.

The visitor’s tax, listed with each rate, is to be paid directly at the hotel. It is subject to change.

Prices include the VAT rate in effect on the date of the order; any change in the applicable VAT rate will be automatically reflected in the prices listed on the invoice date.

Any changes to or introduction of new statutory or regulatory taxes imposed by the competent authorities will be automatically reflected in the prices listed as of the invoice date.

When the Customer’s reservation is confirmed, the total amount of the order will be displayed.

If the price quoted at the time of booking is clearly unreasonably low, or if, by mistake, the quoted price was lower than the rates typically charged by the industry for an equivalent service, the Hotel reserves the right to cancel the reservation outright, without incurring any additional costs in doing so.

All reservations, regardless of their origin, are payable in the hotel’s local currency, unless otherwise specified on site.

Any additional charges and/or compensation for damage or missing items and furnishings may be charged to the bank account associated with the credit card whose details were provided by the Guest at the time of booking. In this regard, the Hotel informs the Guest that their bank details may be retained upon confirmation of their reservation. The Hotel reserves the right to use this data for as long as necessary to fulfill the terms of these terms and conditions of sale. The Guest will be informed in advance of the details and amount of any charges that will be applied to their account in the event of damage discovered at the end of their stay.

Payment

Unless special terms or rates have been selected, the Guest must provide their credit card information as a guarantee of the reservation, using a credit or private card (Visa, Mastercard), by entering the card number, expiration date, and security code directly in the field provided for this purpose. Please note that the credit card used must be valid at the time of the stay. On the day of arrival at the Hotel, the Guest must present the credit card used to guarantee the reservation or make the prepayment. The Manoir du Stang Hotel may also ask the Guest to present a valid form of identification to prevent credit card fraud.

Important note: If the Guest fails to present a valid form of identification upon arrival, the hotel reserves the right to cancel the reservation outright. Under no circumstances will the hotel be required to pay the Guest any compensation.

Payment is due upon arrival at the Hotel or at the time of booking, depending on the payment terms for the selected rate. The only accepted forms of payment are listed on the Website at the time of booking.

At the time of payment, the amount charged at the time of booking includes: the cost of accommodation, taxes related to accommodation, the cost of meals, taxes related to meals, and any other additional services selected by the Guest, excluding the tourist tax and/or any other tax that may be due as a result of the Guest’s stay at the hotel.

Personal data

On each form used to collect personal data, the Customer is informed whether responses are required or optional by the presence of an asterisk.

If any required information is missing, the hotel may be unable to process your reservation or handle any related complaints.

Personal data relating to the Hotel’s guests is collected, processed, and stored by Manoir du Stang in accordance with applicable data protection laws and regulations, including the French Data Protection Act of January 6, 1978, as currently in force, and Regulation (EU) 2016/679 of April 27, 2016 (General Data Protection Regulation — GDPR).

Hotel guests have the right at any time to access, correct, or delete their personal data, to restrict its processing, to request data portability, and to provide instructions regarding the handling of their personal data in the event of their death. These rights may be exercised at any time and by any means by contacting Manoir du Stang, including:

Evidence Convention

By entering the required banking information and accepting these terms and conditions, as well as the voucher or reservation request, you agree to the hotel contract between the parties, which has the same legal effect as a handwritten signature.

The electronic records stored in Manoir du Stang’s computer systems will be maintained under reasonable security conditions and will be considered proof of communications, orders, and payments between the parties.

Force majeure

Manoir du Stang shall not be held liable to the Customer for any failure to perform its obligations resulting from an event of force majeure occurring within French territory.

Similarly, the Customer shall not be held liable to Manoir du Stang in the event of a failure to perform its obligations resulting from a force majeure event. Force majeure events or unforeseeable events are those generally recognized by the case law of French courts and tribunals and by French statutory law.

Governing Law

These Terms and Conditions of Sale are governed by French law. This applies to both substantive and procedural rules.

In full

These General Terms and Conditions of Sale, the terms and conditions of sale for the rate booked by the Customer, and the acceptance of the booking confirmation constitute the entire agreement between the parties.

No general or specific terms and conditions provided by the Customer shall be incorporated into these terms and conditions.

The documents constituting the contractual obligations between the parties are, in descending order of priority, the reservation request (including the specific terms and conditions of the reserved rate) that has been confirmed by the Customer, and these general terms and conditions.

Changes and Modifications to the Terms and Conditions of Sale

These Terms and Conditions may be modified and/or supplemented at any time by Manoir du Stang. In such cases, the updated version of the Terms and Conditions will be posted online. Once posted, the updated version of the Terms and Conditions will apply to all new reservations made on the Website.

Consumer Mediation

In the event of a dispute between the business and the consumer, they will endeavor to reach an amicable resolution.

If an amicable agreement cannot be reached, the consumer may, free of charge, refer the matter to the consumer ombudsman with jurisdiction over the business, namely Médiation Tourisme Voyage (MTV), within one year of sending the written complaint to the business.
